Windy B. McCracken is an attorney at Kauff Laton Miller LLP. Windy is an accomplished litigator with extensive experience in commercial disputes. Windy has litigated matters in state and federal courts across the country involving insurance, securities law, mass torts, employment class actions, breach of contract and breach of fiduciary duty actions. She has handled small business disputes, “bet the company” litigation and large, precedent-setting matters.
Windy graduated law school from Boston University School of Law, where she was on the International Law Journal. She obtained her bachelor’s degree in English Language and Literature cum laude from Baylor University.
Before joining Kauff Laton Miller LLP, Windy was an associate at Hughes Hubbard & Reed LLP where she worked for 10 years before serving as in house counsel to a multibillion-dollar turnaround middle-market investment firm that managed control investments in 30+ companies in numerous industries.

- Representation of multinational insurance company in coverage disputes arising from the Russian Government’s seizure of foreign owned commercial aircraft.
- Representation of CEO in bench trial for breach of fiduciary duty and fraudulent transfer.
- Representation of investment firm in ERISA and WARN Act litigations.
- Successfully opposed Summary Judgment motion for breach of contract and unfair competition matter.
- Represented business owner in a contentious business divorce with allegations of fraud and breach of fiduciary duties.
- Represented the Trustee of Lehman Brothers Inc. (LBI) in one of the most complex insolvencies in history in which more than $115B was returned to LBI’s customers and creditors.
- Conducted comprehensive investigation into actions of clearing agency leading up to LBI’s bankruptcy.
- Represented MF Global Inc. (MFGI) Trustee in estate distribution of $8B+ to MFGI customers and creditors, including conducting investigation into a $1.5B shortfall at SEC/CFTC-registered broker-dealer subsidiary.
- Represented Pharmaceutical company facing hundreds of millions of dollars in fines and business-ending claims in DOJ fraud investigation.
- Representation of Pharmaceutical company in securities class action lawsuit.
Successfully defended the Boy Scouts’ trademark to “scout” and “scouting.”
